Terms and Conditions

These Terms and Conditions govern your use of rafiislam.com and enquiries for services provided by RaFi IslaM. By using the site, you agree to these terms. A signed proposal, statement of work, invoice, or service agreement may add to or replace parts of these terms for a specific project.
1. Website purpose
This site presents professional website development, design, consultation, education, and AI automation or integration services. Site content is general information and does not itself create a client relationship, guaranteed availability, or a binding offer.
2. Service enquiries and proposals
Submitting a form or booking a call is a request to discuss work, not automatic acceptance of a project. Scope, deliverables, timeline, fees, revision limits, responsibilities, and support terms will be confirmed in writing before paid work begins. Quotes may expire on the date shown in the proposal.
3. Client responsibilities
Clients must provide accurate information, timely feedback, authorised access, content, brand assets, and approvals needed for the project. Clients are responsible for ensuring they have rights to all materials they provide and that their business, products, claims, and requested functionality comply with applicable laws. Delays in client inputs may change delivery dates or fees.
4. Fees, payments, cancellation, and refunds
Fees, payment schedules, currencies, taxes, deposits, and accepted methods are defined in the applicable proposal or invoice. Unless the project agreement says otherwise, work may pause when an invoice is overdue. Deposits and payments for completed work, reserved time, consultations, digital services, or third-party costs may be non-refundable to the extent permitted by law. Cancellation, rescheduling, and refund terms in the specific proposal, booking page, course platform, or invoice take priority.
5. Changes and out-of-scope work
Requests beyond the agreed scope may require a revised timeline and additional fees. Material changes will be confirmed before the extra work proceeds.
6. Intellectual property
RaFi IslaM retains ownership of pre-existing tools, methods, templates, libraries, know-how, and reusable code unless a written agreement says otherwise. After full payment, the client receives the ownership or licence rights specifically described in the project agreement. Third-party themes, plugins, fonts, stock assets, APIs, and software remain subject to their own licences. Project names, visuals, or outcomes will be used in a portfolio only when permitted by the project agreement or client consent.
7. Acceptable use
You may not misuse the site, attempt unauthorised access, disrupt its operation, submit malware or harmful content, impersonate others, infringe rights, scrape at unreasonable volume, or use the site for unlawful or fraudulent purposes.
8. Site content
Unless otherwise stated, original text, branding, graphics, code examples, course materials, and site design are owned by or licensed to RaFi IslaM. You may view and share links for personal or business evaluation. You may not copy, republish, sell, or create misleading derivative uses of substantial site content without permission.
9. Third-party platforms and services
Projects and this site may rely on third-party hosting, WordPress, themes, plugins, APIs, payment processors, scheduling tools, course platforms, AI providers, or other services. Their availability, pricing, policies, licences, and data practices are outside my control and may change. You are responsible for third-party accounts and fees assigned to you unless agreed otherwise.
10. AI and automation services
AI-assisted features can produce incomplete, inaccurate, or unexpected results. Unless agreed otherwise in writing, clients are responsible for reviewing important outputs before publication or operational use and for ensuring their data and use cases are lawful and appropriate. No AI system is represented as error-free.
11. No guaranteed results
I aim to deliver professional work, but business results depend on many factors outside my control. Traffic, rankings, revenue, conversions, platform approval, uninterrupted uptime, and specific commercial outcomes are not guaranteed unless a written agreement expressly states otherwise.
12. Disclaimer
The website and free content are provided on an “as available” basis. To the maximum extent permitted by law, implied warranties are excluded. Nothing on the site is legal, tax, financial, medical, or other regulated professional advice.
13. Limitation of liability
To the maximum extent permitted by applicable law, RaFi IslaM will not be liable for indirect, incidental, special, punitive, or consequential loss, lost profits, lost data, lost opportunities, or third-party platform failures arising from site use or services. For a paid service, aggregate liability will not exceed the amount actually paid for the specific service giving rise to the claim during the six months before the event, except where liability cannot lawfully be limited.
14. Indemnity
To the extent permitted by law, you agree to be responsible for claims, losses, and reasonable costs resulting from materials or instructions you provide, your unlawful use of deliverables, your breach of these terms, or your infringement of another party’s rights.
15. Suspension and termination
Site access or services may be suspended or terminated for material breach, non-payment, abuse, security risk, unlawful requests, or conduct that makes the engagement unsafe or impractical. Rights and obligations intended to survive termination, including payment, intellectual property, confidentiality, and liability provisions, will continue.
16. Governing law and disputes
Unless a written project agreement states otherwise, these terms are governed by the laws of Bangladesh, without regard to conflict-of-law principles. The parties should first try in good faith to resolve a dispute through written discussion. Unresolved disputes will be submitted to courts of competent jurisdiction in Bangladesh, subject to any mandatory consumer rights that apply in your location.
17. Changes
These terms may be updated as services or legal requirements change. The effective date above identifies the latest version. Changes do not retroactively alter a signed project agreement unless both parties agree.
